2.1 Eligibility

Free trials are offered at our discretion to allow prospective customers to evaluate our Services. Each individual or entity is eligible for only one (1) free trial in their lifetime, unless otherwise specified through a promotional campaign authorized by Attensira.

2.2 Free Trial Limitations

• Free trials are non-transferable and may not be shared or sold
• Free trials are limited to one per person, household, device, payment method, or organization
• Creating multiple accounts to obtain additional free trials is strictly prohibited
• We may verify eligibility using email addresses, payment information, device identifiers, IP addresses, or other means

2.3 Intended Use During Trial

Free trials are provided for evaluation purposes only. You agree to use the free trial in good faith to assess whether our Services meet your needs. The following activities during a free trial are prohibited:

• Excessive consumption: Deliberately consuming all or substantially all of your allocated resources, credits, or quotas within a short period (e.g., within the first 24-48 hours) with the intent to maximize usage before cancellation
• Bulk extraction: Mass downloading, exporting, or extracting data, reports, or insights with no intention of continuing as a paying customer
• Feature exploitation: Using the trial period solely to perform one-time bulk operations that would normally require a paid subscription

2.4 Cancellation During Free Trial

If you cancel your subscription during a free trial period, we reserve the right to immediately terminate your access to the Services, including any data, reports, or insights generated during the trial. You acknowledge that:

• Access may be revoked immediately upon cancellation, not at the end of the trial period
• Any data or reports generated during the trial may be deleted without notice
• You will not be entitled to export data or continue using the Services after cancellation

2.5 Conversion to Paid Subscription

If you choose to continue using the Services after your free trial, you must subscribe to a paid plan. Failure to subscribe will result in termination of access and deletion of trial data.

3.1 General Terms

From time to time, Attensira may offer credits, rewards, referral bonuses, promotional discounts, or other incentives ("Promotional Benefits"). These benefits are subject to the following terms:

• Promotional Benefits are offered at our sole discretion and may be modified or discontinued at any time
• Benefits are non-transferable and have no cash value
• Benefits may expire and are subject to specific terms announced at the time of the promotion
• We reserve the right to revoke benefits obtained through fraudulent or abusive means

3.2 Referral Programs

If we offer a referral program, you agree not to:

• Create fake or duplicate accounts to generate referral credits
• Refer yourself using alternate identities or email addresses
• Use automated systems, bots, or scripts to generate referrals
• Spam, mislead, or deceive others to obtain referral signups
• Purchase traffic or leads specifically to exploit referral programs
• Collude with others to artificially inflate referral counts

3.3 Promotional Codes and Discounts

• Promotional codes are single-use unless otherwise specified
• Codes may not be combined with other offers unless explicitly permitted
• Sharing promotional codes publicly (on coupon sites, social media, etc.) is prohibited unless authorized
• We reserve the right to void orders or revoke discounts obtained through unauthorized code sharing

3.4 Credit and Reward Abuse

Any attempt to manipulate, exploit, or abuse our credit, reward, or promotional systems will result in:

• Immediate forfeiture of all accumulated credits and rewards
• Reversal of any discounts or benefits received
• Potential account suspension or termination
• Billing for the full price of any Services received

4.1 One Account Per User

Each individual may maintain only one account with Attensira. Creating multiple accounts for the purpose of evading restrictions, obtaining multiple free trials, or circumventing usage limits is strictly prohibited.

4.2 Account Sharing

• Account credentials may not be shared with anyone outside your organization
• The number of users permitted under your account is limited to your subscription plan
• Sharing login credentials to exceed your user limit is a violation of these terms
• We may monitor for unusual login patterns that indicate credential sharing

4.3 Identity Verification

We reserve the right to verify your identity at any time, including before granting free trials, applying promotional benefits, or processing refunds. Providing false or misleading identity information is grounds for immediate termination.

4.4 Organization Accounts

If you create an account on behalf of an organization, that organization is bound by these terms. Multiple individuals within the same organization may not create separate accounts to obtain multiple free trials or promotional benefits for the same organization.

As a user of the Services, you agree not to engage in the following prohibited activities:

Illegal Activities

• Using the Services for any illegal or unauthorized purpose
• Violating any applicable laws, rules, or regulations
• Facilitating money laundering, terrorist financing, or other financial crimes
• Engaging in activities that would violate intellectual property rights

Harmful Conduct

• Harassing, abusing, or threatening other users
• Engaging in discriminatory behavior based on race, gender, religion, nationality, disability, sexual orientation, or age
• Impersonating any person or entity or falsely claiming an affiliation
• Attempting to deceive or mislead other users

Technical Abuse

• Attempting to gain unauthorized access to any portion of the Services
• Introducing malware, viruses, or other harmful code
• Interfering with or disrupting the Services or servers
• Reverse engineering, decompiling, disassembling, or otherwise attempting to derive the source code, algorithms, or underlying structure of the Services
• Using automated scripts, bots, or other software to interact with the Services except through our official APIs
• Circumventing any rate limiting, access restrictions, or usage quotas
• Attempting to probe, scan, or test the vulnerability of our systems
• Using VPNs, proxies, or other means to circumvent geographic restrictions or hide your identity for fraudulent purposes

Misuse of AI Products

• Using AI Products to generate harmful, misleading, or deceptive content
• Creating content that impersonates real individuals without consent
• Using AI Products for surveillance or monitoring without proper authorization
• Generating content intended to manipulate public opinion or interfere with democratic processes
• Creating deepfakes or synthetic media intended to deceive

Competitive Misuse

• Using the Services to build a competing product or service
• Benchmarking or analyzing the Services for competitive purposes without written consent
• Reselling, sublicensing, or redistributing access to the Services
• Using insights from the Services to help competitors improve their AI visibility

You may not upload, share, or create content through our Services that:

• Is Illegal: Violates any applicable law, regulation, or third-party rights, including intellectual property, privacy, or publicity rights
• Is Harmful: Promotes violence, self-harm, terrorism, or dangerous activities
• Is Hateful: Contains hate speech, discrimination, or attacks individuals or groups based on protected characteristics
• Is Explicit: Contains sexually explicit material, child exploitation, or non-consensual intimate content
• Is Deceptive: Spreads misinformation, disinformation, or fraudulent content designed to deceive
• Is Invasive: Violates the privacy of others or shares personal information without consent
• Is Spam: Contains unsolicited advertising, promotional material, or repetitive content
• Is Malicious: Contains malware, phishing attempts, or other security threats

7.1 Dependency on Third-Party Providers

Our Services rely on third-party AI providers and other external services to function. These include, but are not limited to:

• AI platforms such as OpenAI (ChatGPT), Anthropic (Claude), Google (Gemini), Perplexity, and others
• Cloud infrastructure providers (AWS, Google Cloud, etc.)
• Payment processors (Stripe)
• Analytics and monitoring tools
• Email and communication services

7.2 No Liability for Third-Party Outages

Attensira is not liable for any service interruptions, data unavailability, or degraded performance caused by outages, changes, or issues with third-party providers. This includes but is not limited to:

• Downtime or unavailability of AI platforms we monitor (ChatGPT, Claude, Perplexity, etc.)
• Changes to third-party APIs, rate limits, or data availability
• Third-party security incidents or data breaches
• Network issues between our Services and third-party providers
• Scheduled or unscheduled maintenance by third-party providers

7.3 Service Continuity

We will make reasonable efforts to:

• Notify you of known third-party outages affecting our Services
• Provide status updates during extended outages
• Resume normal service as soon as third-party services are restored

However, we cannot guarantee specific resolution times for issues outside our direct control. You acknowledge that the availability and accuracy of our monitoring data depends on the availability of the AI platforms being monitored.

7.4 No Refunds for Third-Party Issues

Service credits or refunds will not be provided for outages or issues caused by third-party providers, except as may be required by applicable law or at our sole discretion.

8.1 Fair Usage Policy

While we provide generous usage limits with our subscription plans, all usage is subject to fair use. Fair usage means:

• Using the Services in a manner consistent with normal business operations
• Not attempting to consume disproportionate system resources
• Not using automation to artificially inflate usage metrics
• Respecting rate limits and not attempting to circumvent them

8.2 Rate Limits and Quotas

Your subscription includes specific rate limits and quotas. You agree to:

• Operate within the limits of your subscription plan
• Not use technical means to bypass or circumvent rate limits
• Upgrade your plan if you consistently require higher limits
• Accept that exceeding limits may result in throttling or temporary suspension

8.3 API Usage

If you access our Services via API, additional restrictions apply:

• API keys are confidential and may not be shared or published
• Automated requests must respect rate limits and include proper identification
• Bulk operations should be spread over time, not concentrated in bursts
• We reserve the right to revoke API access for abusive usage patterns

8.4 Monitoring and Enforcement

We monitor usage patterns to ensure fair use and may take action including:

• Throttling requests that exceed normal usage patterns
• Contacting you to discuss unusual usage
• Requiring an upgrade to a higher-tier plan
• Suspending access in cases of severe abuse

If you encounter any content or behavior that violates this Policy, please report it to us immediately. We take all reports seriously and will investigate promptly.

Violations of this Policy may result in one or more of the following actions, at our sole discretion:

• Warning: A formal warning about the violation and reminder of our policies
• Credit/Reward Forfeiture: Immediate loss of any accumulated credits, rewards, or promotional benefits
• Content Removal: Removal of any content that violates this Policy
• Feature Restriction: Limiting access to certain features or capabilities
• Temporary Suspension: Temporary suspension of access to the Services
• Permanent Termination: Permanent termination of your account and access to the Services without refund
• Billing Adjustments: Charging for the full price of Services received through fraudulent discounts or promotions
• Legal Action: Referral to law enforcement or pursuit of legal remedies where appropriate

The severity of the consequence will depend on the nature and frequency of the violation. We reserve the right to take immediate action without prior warning in cases of severe violations, including but not limited to fraud, security breaches, or activities that harm other users or our business.

If your account is terminated for violation of this Policy, you will not be entitled to any refund of prepaid fees, and you may be prohibited from creating new accounts in the future.
